“EARTHQUAKE WORKSHOP WITH TECHNICAL, SOCIAL, ECONOMIC, AND LEGAL DIMENSIONS” COMPLETED

ON THE SECOND DAY OF THE WORKSHOP, SPEAKERS DISCUSSED THE PRIVATE, PUBLIC, AND INSURANCE LAW DIMENSIONS OF THE EARTHQUAKE

  "Earthquake Workshop with Technical, Social, Economic, and Legal Dimensions" organized with the cooperation of Karatay Municipality and HUDER Konya Branch, ended. On the last day of the workshop, where the earthquake was discussed widely for two days, the private and public lawsuits filed by earthquake victims and other claimants and the process to be followed for compensation for damages were discussed in detail.

"Earthquake Workshop with Technical, Social, Economic, and Legal Dimensions" organized with the cooperation of Karatay Municipality and HUDER Konya Branch, ended.

On the last day of the workshop at Aziziye Cultural Center, the lawyers discussed the earthquake in terms of private, public, and insurance law in the present instance. On the second day of the workshop, the first session of the workshop was moderated by Lawyer Oktay Unkur, the Bar President.

Prof. Dr. Haluk Hadi Sümer, from Selçuk University Faculty of Law, discussed the measures taken to protect employment in the provinces where the State of Emergency was declared due to the earthquake under the title of "Consequences of the Earthquake with the Dimension of Labor Law". Haluk Hadi Sumer said; “According to the said article of the Decree-Law No. 125, a ban on termination of employment contracts has been imposed during the state of emergency as of February 22. Such regulation was required during this period, and it was so right decision to impose such a ban with expressions similar to the pandemic period.

Assoc. Prof. Dr Alper Uyumaz,  Selçuk University, Faculty of Law made his presentation under the title of "The Consequences of the Earthquake with the Dimension of Inheritance Law", and said that to exercise a right, there must be final enrollments, documents, information, or a witness. Uyumaz emphasized that the inheritors in the earthquake zone can also seek their rights within the framework of existing regulations.

Again, Assoc. Prof. Dr. Mehmet Akçaal from Selçuk University, Faculty of Law shared his knowledge and experience with the participants under the title of "landlord's liability". Assoc. Prof. Dr. Mehmet Akçaal underlined that the main responsibility of the buildings or structures destroyed due to the earthquake is the landlords of the building. Akçaal stated the following; “If there is a building that has any deficiency in its construction due to the use of sea sand or bad materials and if this building destroys due to an earthquake, we hold it responsible without seeking the fault of the landlord of the building.”

The last session of the workshop was held under the title of “Earthquake with the Dimension of Insurance Law and Public Law”. In the last session moderated by Lawyer Salih Osman Çağman,  Nazım Taha Koçak, president of the 4th Administrative Law Chamber of the Regional Administrative Court, spoke under the title of "The Consequences of the Earthquake with the Dimension of Administrative Actions".  Nazım Taha Koçak, who gave information about the cases related to the earthquake and the processes of these cases, stated that the Full Remedy and Annulment Actions would be the most after the earthquake. Lawyer Hasip Şenalp, who made his presentation under the title of "The Consequences of the Earthquake with the Dimension of Criminal Law", referred to the details in the relevant articles of the Turkish Penal Code after such developments. Dr. Aytekin Çelik, the faculty member of the KTO Karatay University, Faculty of Law, discussed the process to be followed in the compensation of earthquake victims' losses in his presentation titled “The Consequences of the Earthquake with the Dimension of Insurance Law”.

On the other respects, the final declaration of the "Earthquake Workshop with Technical, Social, Economic and Legal Dimensions", organized with the cooperation of Karatay Municipality and HUDER Konya Branch, shall be published by Karatay Municipality with the contributions of HUDER.
